I finally exhausted all phone calls to every agency & public official I cound find. One friend suggested the news media, so I wrote to a popular investigative reporter in our area. Here is her response, attached to my email I sent:

On Monday, May 14, 2007 I was informed through an organizational web

about abuse & neglect of some very small, very delicate animals at THE
PET
FAIR in the Woodlands Mall.

we've taken to try to get help for them. I personally have filed formal
complaints with Houston SPCA R.A.I.D.E.R. Program,
the USDA APHIS (animal welfare), and made multiple calls to regional law
enforcement agencies.

Other than a form letter from USDA that my complaint was received, after
10
days, I have YET to find anyone that can help with these animals.
Yesterday
I went into the pet store, discovered that the flying squirrels were
gone,
but they still had the Sugar Gliders there, kept in the same conditions
as
before.

There are 3 National Organizations that promote welfare, proper care,
responsible ownership and rescue/rehabilitation on Southern Flying
Squirrels
and Sugar Gliders. I am a member of The National Flying Squirrel
Association, and own 4 flyers myself. (I post under the name "peep")

I do need to point out that a person needs a USDA license to breed and
sell
Sugar Gliders, and a check of USDA files shows that The Pet Fair does
NOT
hold a license. They operate 2 stores, one in the Woodlands, and the
other
in Willowbrook Mall.

Sugar Glider/Flyer breeding mills are as prevalent and as corrupt as
puppy
mills. They're practices are much worse, because they can misrepresent
the
age and temperament of the animal due to it's small size. There are too
many issues connected to cover in this email, but can be found through
the
many professional organizations on the internet.

Please try to help any way you can, the only other option we can think
of is
public exposure. Law enforcement agencies who claim to protect animals
have
certainly let us down.

I am attaching the complaint emails that I've sent to both USDA and
RAIDER.

Nice, Usually when pet stores get a bad rep in writing things get done, I hope this works finally...You can also try calling a t.v station based out there...

Lately like all my news stations have this kind of a help line to expose bad buisnesses, Usually it's to get money back for people, but I think they might take this case on in a heart beat.

Follow up from Amy Davis, KPRC Local 2 News:

Hi Evelyn,

This is the message I got back from the Houston Humane Society.

Amy-

Timmers tells me he did take the referral on this case, but passed it on
to the local Animal Control as well as the management of the local mall,
as he can only investigate outside his jurisdiction when the local law
enforcement requests his help.

But hopefully Timmers' referral of the situation to them carried weight
behind it, and the case will get resolved quickly from here on out.

Wouldn't local animal control be Montgomery County?

I was out yesterday and just got back to work today. I'll let you know
if I hear anything more.
